Jawaharlal Nehru University (JNU) alumni Umar Khalid on Wednesday challenged the Supreme Court, challenging the Delhi High Court order, which refused to grant him bail in the UAPA case related to the alleged big conspiracy behind the 2020 north-eastern Delhi riots.
The Delhi High Court refused to grant bail on September 2 on 2 September 2, Umar Khalid, Sharjil Imam, Mohd Salim Khan, Shifa Ur Rehman, Athar Khan, Miran Haider, Shadab Ahmed, Abdul Khalid Saifi and Gulfisha Fatima. Imam and Gulfisha Fatima have also moved the apex court challenging the High Court order.
The Delhi Police had opposed their bail pleas, saying that it is not a matter of spontaneous riots, but is a case in which the riots were already planned and a frightening motive and a well-conspired conspiracy was behind it. The higher court said that prima facie, the role of Imam and Khalid in the entire conspiracy is “serious”, because they have to launch the members of the Muslim community “because they have to launch the masses” in the entire conspiracy. Inflammatory speeches were given on communal basis.
Khalid in February 2020 sought bail from the apex court in the case of large conspiracy under the strict provisions of the illegal activities (prevention) Act (UAPA) in the case of Delhi riots. In 2020, in 2020, Delhi Police arrested Imam under UAPA and described him as the chief conspirator in the Delhi riots case.
In 2020, Delhi Police arrested the Imam under the UAPA and described it as the main conspirator in the Delhi riots case. The then proposed Citizenship Amendment Act (CAA) and the protest against the National Register of Citizen Register (NRC) erupted violence during the protests and 53 people were killed and more than 700 were injured.
