Shimla. An important decision of the Himachal Pradesh High Court has brought a happy opportunity for the outsourced employees working under the state government. The Himachal Pradesh High Court has ordered the Horticulture Department to regularize the employees kept under the outsourced in all its offices. Himachal Pradesh Horticulture Department has around 900 outsourced employees. Himachal Pradesh has a policy to regularize employees. In this policy, there is a provision to regularize the service of employees working on contract for two years. Justice Sandeep Sharma of Himachal Pradesh High Court has ordered regularization of employees of Horticulture Department on the basis of this policy.
Justice Sharma’s bench had a petition in this regard. The bench gave the basis of several decisions of the Supreme Court and the High Court. The bench of the Himachal Pradesh High Court said that it is clear that as a welfare state, the policy director’s principle of the state government shows the constitutional duty to protect human dignity. On the basis of outsourced in Himachal Pradesh Horticulture Department, Project Manager, State Horticulture Development Committee or Director Horticulture was placed as Junior Engineer, Assistant Engineer, Draftsman, Surveyor, Technical and General Facilitator, Posted Officer, Programmer, MA Purchase, MA Accounts, Farm Manager, Assistant Farm Manager and Office Assistant.
The Himachal government said in the High Court that the petitions are not the Horticulture Department, but the employees of the society. Which is an autonomous body. In this way these employees cannot be given the benefit of regularization policy of Himachal Pradesh government. The government said that once the work of the society is over, he cannot claim to regularize. The government also argued that contracts and outsourced are different and the policy of regularizing the petitioners does not apply here. At the same time, demanding to regularize themselves, the petitioners said that similarly appointments were made at the first temporary and contract in Sarva Shiksha Abhiyan, School Education Society of Education, School Education Society of Education, Department of Education under Himachal Pradesh Natural Resources Management Society, Forest Department, Department of Revenue Department, Electricity Corporation, Power Corporation, Zoo Society Red Cross Society Vagaira. They were later adjusted.
