Every year, with the onset of cold season, incidents of stubble burning take place in Punjab, Haryana and Western UP. Recently, news had come that 31 cases of stubble burning had come to light in Punjab and a case had also been registered against the farmers. The situation is such that not only the instructions of the Punjab Government, the farmers there are not even following the orders of the Supreme Court. Angered by this, Supreme Court Chief Justice BR Gavai had recently said during the hearing of the pollution related case that if some farmers are sent to jail, then perhaps other farmers who burn stubble will learn a lesson. Despite this harsh comment of CJI, incidents of stubble burning are happening.

Chief Justice BR Gavai had clearly said that since the year 2018, the Supreme Court has given many orders on not burning stubble, but the farmers only show helplessness. At the same time, during the hearing, Punjab government’s lawyer Rahul Mehra had said that stubble burning has reduced in the state in the last few years. He had said in the court that this year will be better. The lawyer of Punjab government had said that most of them are small farmers and what will happen to the family if they are sent to jail. When this argument was made by the Punjab government’s lawyer about the small farmer, the Chief Justice had said that there is no need to send everyone to jail, but it is necessary to do so to send a message.
