The Supreme Court has relaxed some of the conditions imposed on interim bail given to MLA Abbas Ansari in the Gangster Act case. A bench of Nyayamurthy Suryakant and Justice Joymalya Bagchi allowed Ansari to travel outside Uttar Pradesh. For this, he amended a condition under which he was not allowed to travel outside the state.
However, the bench clarified that Ansari would have to provide other details of his destination and other details of the journey to the trial court whenever he wants to travel out of the state. The House Court has also changed another condition imposed on Ansari, under which he did not have to change his current residence in Lucknow. Under this, they have been allowed to stay at a separate address. This exemption will also depend on Ansari on submitting details of the new residential address to the local police and the lower court.
The court was hearing a petition filed by Ansari seeking to remove the conditions imposed on his interim bail. Senior advocate Kapil Sibal, appearing on behalf of Ansari, also demanded that the court could also relax in conditions to prevent Ansari from giving public speech.
However, the court clarified that it had not prevented Ansari from speaking publicly. The court said that in fact, Ansari, being a public person, can always speak on social and economic issues, as politicians usually do. The court made it clear that the said condition is limited to the extent that Ansari will not speak publicly about the ongoing matters in which they are involved in the court (they are pending to decide by the court).
The court further clarified that its purpose is not to silence Ansari, but to save the court from the attack on social media, as is recently happening. It may not make any mistake; It may be that he gives a statement in innocence. But the way it will be post -mortem at night (on social media). However, when Sibal insisted that the judicial order of speech should be relaxed, as it was scared of giving a speech.
