The Supreme Court today heard the action after the Jahangirpuri violence, in which the Delhi Municipal Corporation had launched a bulldozer campaign against the encroachment. During the hearing, Congress leader and senior advocate Kapil Sibal argued in the Supreme Court that only Muslims were being harassed. However, the government countered this with figures. The Solicitor General told the court, ‘The allegation of targeting a community is wrong. In Khargaon in Madhya Pradesh, 88 affected parties are Hindu. I’m sorry I had to split them. The government does not want to do this, but, I am being forced to do so.
Let us tell you that during the hearing, Kapil Sibal told the court, “I have such pictures in which the houses of people of one community were vandalized. It is a process of instilling fear in them. On this, Judge J Rao said that what relief are you claiming.
To this Sibal said, “You cannot link encroachments with one community. Encroachments are not limited to A and B community. You cannot demolish houses just by saying that they are encroached upon. This platform is to show that the rule of law prevails. On this demand of Sibal, Judge J Rao said that we cannot stop the demolition across the country.
Sibal again said, “Encroachment is wrong. But are you associating Muslims with encroachment.” Justice Rao again asked, no Hindu property was vandalized?
During the hearing, it was said on behalf of the petitioner, “This matter is not limited to Jahangirpuri. It is a matter affecting the social fabric of our country. If this is allowed, the rule of law will not survive.” Write letter to municipal commissioner to start demolition and they demolish after that? Municipal corporation act notice, serve of appeal..See Olga Tellis case, where Supreme Court has protected.”
