The Kerala High Court on Monday said that there cannot be two standards of law, one for the powerful and one for the common citizens. The court’s observation observed that the Left government had been unable to stop the flag mast without permission by political parties, despite the court’s order. The High Court said, it should be kept in mind that the flag pole installed without permission is illegal and is carried out only by powerful people or political parties. You will not allow any common citizen to do this. There cannot be two laws, one for the powerful and the other for the common people.

Instead of supporting an initiative initiated by the High Court, the state government is doing nothing. The court further said that the state had earlier sought three months’ time to come out with a policy to control the installation of flag poles, and now it is seeking more time for the same. The court said that when the executive asks for time from the judiciary, there should be an honesty attached to it and not just because you want to ask for time.
Additional solicitor general Ashok M Cherian and senior public prosecutor S Kannan, appearing for the state, submitted that though the government machinery has to take control of the flag pole and ensure that no new pillar is erected without permission, all the parties have to come together. Need more time to get it. Giving time till March 28 on this, the court reiterated that when the government asks for more time, there should be honesty in it. The court was hearing a plea of a cooperative society alleging that a particular political party is illegally putting up flags and banners on its land.
