The Supreme Court has seen a conflict between the Collegium and the Center on several issues. But the government has to say that it is working seriously to fill the vacant posts in the judiciary. In the post-2014 era, 198 new posts of judges were created due to the efforts of the government, then the government is trying hard to implement the reservation in the judiciary.
On the question of Congress MP Anumula Reddy and YSR Congress’s Chandrasekhar Belna in Parliament, Union Law Minister Kiren Rijiju said that work is going on on 175 proposals sent by the Collegium to the Supreme Court. Whereas no proposal has come so far regarding 230 vacancies in the High Courts. Both the MPs had asked that what is the government doing to implement the system under social justice in the judiciary?
The government said that for the appointment of judges in the High Court, work is being done under Articles 217 and 224 of the Constitution. There is no provision for any kind of reservation in this, but still the government has asked the Chief Justices of the High Courts to prepare the draft keeping in mind the SC / ST, women and minorities while preparing their proposals.
Over 1 lakh cases of SC/ST harassment in 3 years
1,61,117 cases were registered in the country under the Scheduled Castes, Scheduled Tribes Prevention of Atrocities Act 1989 in a period of three years from 2018 to 2020. This information was given by the Minister of State for Social Justice and Empowerment Ramdas Athawale in a written reply to Danish Ali’s question in the Lok Sabha. According to Athawale, 49,064 cases were registered in the year 2018, 53,515 cases in the year 2019 and 58,538 cases in the year 2020 under the Scheduled Castes, Scheduled Tribes Prevention of Atrocities Act 1989 across the country.
The Minister informed that Police and Public Order are State subjects and Scheduled Castes, Scheduled Tribes Prevention of Atrocities Act 1989 is implemented by the respective State Governments and Union Territory Administrations. Athawale said that the government is reviewing the state government with law implementing agencies to ensure speedy registration of cases related to atrocities, speedy investigation of crimes and timely disposal of cases by the courts.
