Islamabad: The interference of Pakistani intelligence agency ISI has now passed through the government and has reached the judiciary. ISI is getting its desired decisions taken in the court. It clearly means that democracy in Pakistan has gone to ICU. Now not even a leaf can move here without the will of ISI. this complaint Six judges of Islamabad High Court have joined the Supreme Court. The judges have said that Pakistan’s influential intelligence agencies are interfering in the functioning of the judiciary. The judges have appealed to the Supreme Judicial Council to take cognizance against ISI.
A letter signed by these six judges demanded a judicial mechanism from the Supreme Judicial Council against such interference in judicial matters. The six judges who have signed the March 25 letter include Justice Mohsin Akhtar Kayani, Justice Tariq Mahmood Jahangiri, Justice Babar Sattar, Justice Sardar Ijaz Ishaq Khan, Justice Arbab Muhammad Tahir and Justice Saman Rafat Imtiaz. The letter calls for a tough stance to be taken to ensure the independence of the judiciary through the system.
ISI is putting pressure on judges in decisions
The Supreme Judicial Council is the apex body authorized to take action against judges of the High and Supreme Courts. The letter also mentioned examples of interference by the executive and agencies to put pressure on judges. The letter said that his relative was kidnapped and tortured to put pressure on a High Court judge in a case. It said, “We would also like to draw attention to the fact that the code of conduct for judges prescribed by the Supreme Judicial Council does not provide any guidance as to what steps should be taken in cases such as interference with judicial independence.”
The Supreme Court has declared the dismissal of the former judge wrong
The apex court had declared the decision to remove former Islamabad High Court Justice Shaukat Aziz as illegal and said that he can be treated as a retired judge. This letter has been written after this decision of the court. The judgment said the Supreme Judicial Council acted against Justice Siddiqui on the assumption that the truth or falsity of the allegations made by the former judge was “irrelevant”. Siddiqui was dismissed by the Supreme Judicial Council on 11 October 2018 over a speech in which he accused the country’s powerful intelligence agency ISI of influencing court proceedings.
In their letter, the Justices of Islamabad High Court have supported the demand for investigation into the allegations made by Justice Siddiqui. The letter is considered unprecedented as it officially exposes the alleged involvement of the executive and intelligence agencies in judiciary matters and seeks the support of the apex body SJC to take action against judges and provide guidance on such matters.
