Mumbai: Dismissed RPF constable Chetan Singh Chaudhary, accused of killing four people inside a train last year, on Monday demanded from the court that for the sake of “fair trial and justice” he should be shifted from Akola jail to a jail near Dindoshi court in Mumbai’s northwest. Be sent to the facility. Akola is located in the Vidarbha region of the state, whose distance from the metropolis is more than 550 kilometers.
Additional Sessions Judge AA Ayachit has sought a report in this regard from the authorities of Arthur Road (Mumbai) and Taloja Jail (Navi Mumbai). The court has asked the authorities to submit a report whether the accused can be kept in these jails. The judge also directed Akola jail authorities to produce Choudhary before the court. The next hearing of the case will be on March 30.
In his plea filed through advocate Jayant Patil, the accused constable said he was transferred to a “remote and unsafe” jail without taking any opinion or order from the magistrate court, which heard the case during the remand stage. In the petition, the accused claimed that he was shifted to Akola Central Jail for security reasons and was not produced in the court for a long time.
The petition filed in the court said that Arthur Road and Taloja jails are more safe and convenient, as they are only 25 kilometers and 49 kilometers away from Dindoshi Sessions Court. The application states that the accused is facing serious charges and hence his presence in the courtroom is necessary for a fair trial and natural justice.
The plea filed by Patil claimed that it is the duty of every jailer to keep a prisoner safe and hence, there is no valid reason to transfer Choudhary to a remote jail for safe custody. He said that further instructions are required from the accused to file the discharge application.
Accused RPF constable Chetan Singh Chaudhary is accused of shooting dead his senior officer, ASI Tika Ram Meena, and three passengers on the Jaipur-Mumbai Central Express near Palghar on July 31 last year. He was caught with his service weapon from the side of the railway track at Mira Road after passengers pulled the train’s alarm chain.
