new Delhi . The Supreme Court on Tuesday said that the mental and physical damage caused to a road accident victim cannot be calculated with money, but there is no other way of compensation. A division bench of Justice Hemant Gupta and Justice V. Ramasubramaniam increased the compensation paid to a 5-year-old boy at the time of the accident to Rs 49.93 lakh along with interest. The boy has suffered serious injuries and is now paralyzed.
The Bench observed that the appellant was not able to move both his legs and had swelling of the legs, urinary incontinence and bowel constipation and bed sores. Determination of damages in personal injury cases is not easy. Mental and physical harm cannot be calculated in terms of money, but there is no way other than payment of compensation to the victim.
The apex court’s decision came on an appeal filed by the boy against the Karnataka High Court order, which had awarded a compensation of Rs 13.46 lakh as against Rs 18.24 lakh given by the Motor Accident Claims Tribunal.
The bench said that the court has dismissed the claim of taxi cost on the ground that the taxi driver has not been produced. It is impossible to offer many taxi drivers.
“The compensation comes to Rs 49,93,000, plus interest already paid by the Court and confirmed by the High Court, i.e. 7.5 per cent per annum from the date of filing of the claim application till recovery.”
