The top court also took note of the contention that Mukul Roy’s tenure as chairman of the Public Accounts Committee (PAC) of West Bengal is only for one year. The Supreme Court asked the Calcutta High Court to decide the matter under Mukul Roy’s tenure in the PAC within a month. Senior advocate CS Vaidyanathan, appearing for the officer, told the bench that Speaker Viman Banerjee’s decision was completely arbitrary. . In fact, West Bengal President Viman Banerjee had on February 11 rejected the appeal of the Leader of Opposition in the Assembly, Shubhendu Adhikari.
Actually, Mukul Roy is accused of changing the party after the West Bengal Assembly elections. Mukul Roy, a former BJP national vice president, had joined the ruling Trinamool Congress (TMC) in West Bengal in June after the election results. Roy was in TMC even before BJP. There was a demand to disqualify Mukul Roy as an MLA while taking action under the Anti-Defection Act.
The Speaker of the Assembly and Secretary to the Returning Officer of the West Bengal Legislative Assembly also filed a petition in the apex court against the order of the Calcutta High Court. The High Court had directed the Speaker to decide by October 7 last year on a plea seeking disqualification of Rai from the BJP for joining the Trinamool Congress. The High Court order came on a plea by BJP MLA Ambika Roy challenging the appointment of TMC MLA Mukul Roy as the chairman of the Public Accounts Committee (PAC) of the West Bengal Assembly.
