The order has been issued by the RERA authority after receiving several complaints about builders taking money and dumping them in the name of maintenance deposit of the society. According to which the society gets BU permission from now onwards, then the responsibility of its maintenance will be with the builder. Not only this, until the BU is not received, then no amount can be taken from the customer in the name of any maintenance or maintenance deposit.
In the order given by RERA on 30 March, it was said that till the time any society or commercial complex does not get BU permission, the responsibility of its maintenance will remain with the builder. Maintenance or maintenance deposit can be taken by the builder only after getting the BU permission. However, this amount will have to be deposited by the builder in a separate bank account and this amount cannot be taken in cash form from any customer.
After getting the BU permission, expenses can be made from this bank account for the common services and amenities of the society. However, if a builder has used money from this fund before getting the BU permission, then he will have to return that amount along with interest.
