Delhi’s Rouse Avenue Court has issued a notice to former Congress President and Rajya Sabha MP Sonia Gandhi. The Special Judge’s Court has issued a notice to Sonia Gandhi regarding the allegation that she had added her name to the voter list in 1980, before acquiring Indian citizenship. The court has issued this notice in response to a revision petition filed against the dismissal of an earlier petition.
A notice has been issued regarding inclusion of Sonia Gandhi’s name in the voter list before she gets Indian citizenship. A petition in this regard was dismissed, against which a revision petition was filed. Hearing the case, the court issued notice to Sonia Gandhi, alleging that she had got her name added to the voter list in 1980 before acquiring citizenship in 1983.
Petition filed against Sonia Gandhi
The petitioner, Vikas Tripathi, challenged the magistrate court’s order rejecting his plea to lodge a First Information Report (FIR) against Sonia Gandhi. He alleged that Sonia Gandhi’s name was included in the voter list of New Delhi Assembly constituency in 1980, whereas she became an Indian citizen only in 1983. The petition said this indicates that forged documents may have been used to include his name for the first time.
Vikas Tripathi argued that this is a cognizable offense and an FIR should be registered. Additional Chief Judicial Magistrate (ACMM) Vaibhav Chaurasia had rejected the petition in an order dated September 11. ACMM said that investigating issues related to voter list is beyond the jurisdiction of the court and would be a violation of Article 329 of the Constitution, as these matters fall under the purview of constitutional bodies. After this, Vikas Tripathi filed a new petition in the court, after which a notice was issued to Sonia Gandhi. Court sought answer from Sonia Gandhi
Rouse Avenue Court has issued notices to Sonia Gandhi and Delhi Police seeking their response on a revision petition filed against Sonia Gandhi for allegedly fraudulently including her name in the voter list without acquiring citizenship. The petitioner claimed that Sonia Gandhi had obtained citizenship on April 30, 1983, while her name was included in the voter list of 1980. The petition raised questions as to how his name was included in the New Delhi Voter List of 1980. In 1982, Sonia Gandhi’s name was removed from the voter list. The question was raised in the petition as to why it was removed. It was also asked that if he had got citizenship in 1983 itself, then on what basis his name was included in the voter list of 1980, and whether fake documents were used.
