India’s Department of Telecommunications (DoT) has issued a strict warning to mobile users. The department says that if the SIM card issued in your name is used for cyber fraud or illegal activities, then legal action can be taken against you, even if you have never used the connection. This means that if the SIM is in your name, you will be considered completely responsible.
What mistakes can send you to jail?
DoT has clearly stated that users should avoid any activity that may lead to legal action. This includes using a phone with an altered IMEI number. If you use a phone whose IMEI number has been tampered with, you may be subject to action.
Getting SIM card using fake documents
Obtaining or obtaining a SIM card using false identity, false documents or someone else’s identity is a serious offence.
Giving your SIM card to someone else
Most important warning: Never give your properly purchased SIM card to a third party. This is the most common method used by cybercriminals.
New Telecommunication Act 2023
Under the new law, tampering with telecommunication identifiers (like SIM, IMEI) or committing SIM fraud will now be considered a serious crime. It can result in a jail term of up to three years and a heavy fine of up to ₹50 lakh. Using your SIM card in a crime, even if you did not commit the crime, can be considered complicity.
How to protect yourself?
DoT has appealed to people to use Sanchar Sathi portal or app. This platform gives information about all the SIM cards registered in your name. It also lets you check whether the IMEI number of any mobile device is genuine or not. With this you can instantly remove any suspicious SIM cards in your name and strengthen your digital security.
