After 32 years of massacre of Kashmiri Pandits, once again the Supreme Court has appealed for justice. An organization of Kashmiri Pandits has filed a curative petition in the Supreme Court seeking a probe by the Central Bureau of Investigation (CBI) or the National Investigation Agency (NIA) into the alleged mass killings and genocide of Kashmiri Pandits during 1989-90.
This petition has been filed by an organization called Roots in Kashmir. This organization of Kashmiri Pandits has requested the top court to investigate the matter again. Let us tell you that in 2017 the Supreme Court had rejected the application filed in the case of the death of Kashmiri Pandits. At that time the court had said that there is no evidence in the case after 27 years.
Vivek Agnihotri’s film The Kashmir Files, which was released in theaters recently, has once again made an all-out demand for justice to Kashmiri Pandits.
In the same sequence, the petition filed by Roots in Kashmir states, “It is wrong to dismiss the case on the ground of delay. It has been said on behalf of the petitioner that the matter should be reopened and the application should be dismissed on the ground of delay.” It is the main premise and this premise is wrong. It is said to be faulty in the eyes of the law.”
The petition referred to the anti-Sikh riots
A statement on behalf of the organization said that a certificate has been issued by Vikas Singh, Senior Advocate and President of Supreme Court Bar Association, in support of the Curative Petition. The curative petition also referred to a 2018 Delhi High Court order on Sajjan Kumar in the anti-Sikh riots case, allowing the appeal, saying: “It is important to assure those countless victims who wait patiently that despite the challenges Truth will prevail and justice will prevail…”
Question on Kashmir Police
The petition states: “In the years 1989-90, 1997 and 1998 all FIRs/cases of murder and other allied offenses against Kashmiri Pandits shall be investigated by an independent investigative agency such as CBI or NIA or any other agency appointed by this Court.” should be transferred, as the J&K Police has miserably failed to make any progress in the hundreds of FIRs pending with them till now.”
The petition sought the prosecution of Yasin Malik and Farooq Ahmed Dar alias Bitta Karate, Javed Nalka and others for hundreds of FIRs in the killings of Kashmiri Pandits during 1989-90, 1997 and 1998, and against whom even after 26 years The investigation was not conducted by the J&K Police.
The petition urged the apex court to issue a direction to complete the trial and prosecution of Yasin Malik for the alleged gruesome murder of 4 Indian Air Force officers on the morning of January 25, 1990, which is currently pending before the CBI court. .
