The relationship between husband and wife is the most special which rests on mutual love, trust and dedication. If there is a lack of these things in this relationship then this relationship breaks up. Nowadays, many such cases are heard where husband and wife get divorced from each other while separating from their relationship. During the hearing of one such case, the Supreme Court on Tuesday told a man that even though he is legally divorced and separated from his wife, he cannot separate from his children. The court said that husband and wife can divorce each other, but not divorce their children. Along with this, the court ordered him to pay Rs 4 crore as a settlement.
Let us tell you that during the hearing of the case, the court said that even though you can divorce your wife or partner, but it does not mean that you are separating your children by giving them divorce. You have given birth to them, so you have to take care of them. You will have to pay money for the maintenance of wife and minor children.
According to the information, the top court has also approved divorce with mutual consent of the couple living separately since 2019 under Article 142 of the Constitution. However, a bench of Justices DY Chandrachud and MR Shah said that other conditions between the couple would be followed as per the agreement. Let us tell you that during this hearing, both the parties have reached a mutual agreement, but the husband’s lawyer has sought some more time for payment of the amount fixed by the court for the husband who is suffering heavy losses to his business due to the pandemic. However, the court has said the payment of pre-divorce, saying that the argument of financial constraints is baseless.
