New Delhi. The Kerala High Court has made important remarks while hearing a petition seeking alimony of a Muslim woman. The High Court judge said that if a Muslim man is not able to afford, maintain his wife’s expenses, then he has no right to marry a second or third marriage. Even under Muslim personal law, he does not have the right to do so. This entire case is very interesting, in fact the woman filed a petition in the court to seek alimony from her husband to Rs 10,000 per month, although the woman’s husband herself begs by begging.
The petitioner woman alleged that her husband who is blind, he lives her life by begging. Now leaving him, he is living with his first wife and is threatening to marry a third marriage. The court, while hearing the woman’s petition, said that the defendant belongs to the Muslim community and is taking advantage of his Muslim personal law that allows her to marry more times. But a person who cannot maintain a second or third wife, has no right to second or third marriage.

The court also said that due to lack of education in the Muslim community and lack of information about the customary law of Muslims, there is a trend of more than one wedding. The court, citing the verses of the Quran, said that this sacred book considers polygamy only as an exception. Earlier, the petitioner woman had also filed an application in the family court, but while rejecting her application from there, the court had said that the one who is begging himself cannot be instructed to pay alimony.
