New Delhi . The hearing on the anticipatory bail plea of restaurant owners Gaurav Luthra and Saurabh Luthra in the fire incident at Birch by Romeo Lane restaurant in Margao, Goa was held in Rohini Court of Delhi. Goa Police strongly opposed the bail of both and said that these people had deliberately fled abroad to avoid investigation. Advocate Abhinav Mukherjee, appearing on behalf of Goa Police, presented many evidences to the court. He told that there were no licenses required to run the restaurant. The Panchayat license had already expired and was not renewed. Gaurav Luthra, Saurabh Luthra and Ajay Gupta have been shown as partners in the GST registration. Saurabh Luthra had also applied for the license of FSSAI and Pollution Control Board. That means both brothers were fully involved in the running of the restaurant. Police told the court that immediately after the fire incident, both the brothers started preparations to escape. A flight to Thailand was booked at 1.15 in the night and at 5 in the morning on 7th December, they flew to Bangkok. When the police reached their home, the mother and wife said they had no idea where they were and even refused to give their phone numbers. Police say that he had no business in Thailand. All this was done just to avoid investigation and arrest. After this, non-bailable warrant was issued, LOC was opened and Blue Corner Notice was also issued on 9 December.
Goa Police also said that the restaurant had only one narrow passage, which was difficult to exit. There was no NOC from the fire department, yet the fire show was organized. Due to this, many innocent people got trapped and lost their lives. The police also termed the medical history of the accused as fake. He said that if these people had really gone to Thailand on December 6 and the incident had happened later, then the matter would have been different, but they have deliberately run away.
The lawyer appealed to the court that anticipatory bail should not be given to people who lie before the court and hinder the investigation. Law only helps those who follow the law. The police clearly said that both the brothers should have cooperated in the investigation, but on the contrary they misled the officers. Now the court will hear further in this matter.
