Allahabad High Court did not allow a married person to have a live-in relationship without divorce.

The court said, a married person cannot live in a live-in relationship without divorce, the rights of the existing spouse will be violated.

The Allahabad High Court has delivered an important judgment on live-in relationships, stating that a married person cannot legally live in a live-in relationship with another person without completing his/her valid divorce process. The decision came while dismissing a security-related petition, in which the court stressed that it would be inappropriate for the state to interfere in this particular matter.

Right to personal liberty is not unlimited: Court’s clear stand

Justice Vivek Kumar Singh noted that the right to personal liberty is valid as long as it does not violate the established legal right of another person. According to the court, adopting any other relationship without ending the legal bond of marriage is against the ideas of the Constitution.

Live-in relationships of consenting adults get protection rights

However, the High Court has also said that live-in relationships between consenting adults are part of freedom. If they are facing problems like threats or assault in an extra-marital relationship, police protection should be given. The court has made it clear in several orders that live-in relationships are not illegal.

Key points of the decision: legal status and rights

A married person cannot live in a live-in relationship without divorce – the clear truth of the court. The right to personal liberty is limited; it cannot affect the legal rights of others. Security-related petition dismissed when the petitioner is in a valid married state. Live-in relationships are not illegal; This is a right to liberty and for this an order for police protection can also be given.
