Prayagraj. Caution should be taken while messaging WhatsApp in any group. An example of how inadvertence or ignorance can be overwhelming has come from the Allahabad High Court starting contempt proceedings against a person. The Allahabad High Court has approved a contempt case on the WhatsApp group by making charges against Krishna Kumar Pandey, accused of making derogatory remarks on a judicial officer of Basti district. Krishna Kumar Pandey commented on the judge in the WhatsApp group of the lawyers of Basti District Court.
A bench of Justice JJ Munir and Justice Pramod Kumar Srivastava in the Allahabad High Court said that Krishna Kumar Pandey should be prosecuted for hurting the court’s reputation and reducing the rights of the court under Section 2 (C) of the 1971 law on contempt of court. Krishna Kumar wrote in the Wattic Group of lawyers in Basti that there are serious allegations of corruption against an ADJ. ADJ was written that he was accused of taking bribe and writing fake and fake order letters in the pending case of civil and criminal. The administrative judge of the Allahabad High Court had examined the messages made on WhatsApp. The administrative judge had said that writing such posts is like threatening the judicial system, maligning and terrorizing the court. This is similar to contempt.
After the administrative judge’s report, the case of Krishna Kumar Pandey came to the bench of the Allahabad High Court listening to criminal contempt. In this case, notice was sent to the accused and several rescue opportunities were given, but Krishna Kumar Pandey refused to accept the proposal, saying that he was able to defend himself. The Allahabad High Court bench also found during the hearing that Krishna Kumar Pandey, accused of contempt, is not even a lawyer. Despite this, he is included in the WhatsApp group of lawyers of Basti district. The court also gave notice to the officials of the Bar Association of Basti in this case. On this, he had assured the Allahabad High Court that necessary steps would be taken to prevent the misuse of the WhatsApp group.
