The accused and the complainant woman have known each other since 2012, had made relations many times by promising marriage
The Mumbai High Court refused to dismiss the plea of a man for raping and cheating on a woman. The court said that the man entered into a relationship with the complainant woman with the promise of marriage. However, after having a relationship, the man refused to marry her on the pretext of having a ‘defect in the horoscope’. Due to this, Justice SK Shinde dismissed the petition of the accused.
According to detailed information, the woman had lodged a complaint with the suburban Borivali police. The counsel for accused Abhishek Mitra told the court that the relationship between the two could not be carried forward due to the defect in their horoscope. In such a situation, he also argued that this case is a case of breach of promise, not of false pretext of marriage and fraud.
Justice Shinde, however, refused to accept the contention that it showed that the accused did not want to marry the woman from the very beginning. Therefore, he refused to marry on the pretext of having a defect in the horoscope. Therefore, it will be treated as a case of breach of her consent by giving a false promise of marriage. The complainant woman said that she had known the other of the two since 2012 and had had physical relations with her on several occasions on the promise of marriage.
