New Delhi . The case of FIR and arrests filed in ‘I Love Mohammed’ poster case reached Delhi High Court. Muslim organizations have filed a petition against FIRs and arrests in the High Court. The petition demanded that those against whom cases have been filed, should be withdrawn and those arrested should be released immediately. It has also been argued that the cases were filed against the people of the Muslim community who were celebrating their festival peacefully, by making false accusations of rioting, making criminal intimidation and disturbing peace against them.
According to the petition filed in the High Court, this PIL has been filed under Article 226 of the Constitution of India. It has demanded immediate judicial intervention to protect the constitutional rights of the petitioners. They are all from the minority Muslim community and have been falsely implicated in 20 Sibantar FIs. The FIR has been recorded under the police station Kaisarganj, District Bahraich under Section 187 (intentional punishment for injury), 351 (criminal intimidation), 187 (2)/188 (riot/illegal gathering) and 356 (deliberately insulting peace).
The petitioners are ordinary people, daily wage laborers, students and family. His only crime is that he celebrated his festivals through posters, banners and peaceful meetings. Instead of respecting their rights to religious expression under Articles 25 and 26, they were defamed, targeted and falsely accused by members of the majority community without any concrete evidence. The Supreme Court had said in Bijoy Imanuel vs Kerala State Affairs (1986) 3 SCC 615 that inactive religious expression such as national anthem is also protected by the Constitution due to religious faith. Similarly, the peaceful tasks of the petitioners to install posters and banners as part of the festival cannot be a crime through false FIR.
The petitioner said that implicating the members of the minority community in a false case is not only a violation of their life and the right to freedom under Article 21, but it also damages the secular structure of India guaranteed by Article 14 and 15.
