New Delhi, November 18 (). The Supreme Court on Monday took a tough stand in the Telangana Assembly case, in which it has sought disqualification of 10 MLAs who switched from BRS to Congress under the anti-defection law.
Chief Justice B.R. The bench headed by Gavai warned the Telangana Assembly Speaker that if the petition was not decided within a week, the court would consider it contempt of court.
In fact, after the Telangana Assembly elections held last year, 10 BRS MLAs had joined Congress. After this, BRS had submitted a petition for disqualification against all these MLAs under the Tenth Schedule (Anti-Defection Law) before the Speaker, but even after more than a year, the Speaker did not take any decision.
Angered by this, the Supreme Court had given clear instructions to the Speaker on 31 July 2025 to settle this matter within three months i.e. by the end of October. When the case was heard on Monday, the Speaker informed that no decision has been taken yet. CJI expressed anger on this.
He said in a stern tone, “Either the Speaker should take a decision in a week or he himself should decide where he wants to spend the New Year (2026).” The court’s indication was clear that if the delay continues, contempt action may be taken and the speaker may even have to go to jail.
The court also commented that the Speaker was deliberately postponing the decision so that the ruling party could benefit. Justice P.S. present in the bench. Narasimha and Justice Sanjay Karol also expressed displeasure over the attitude of the Speaker.
The court has given the speaker the last chance to take a final decision till the next hearing i.e. in a week.
