Under the Hindu Marriage Act, a married woman cannot seek protection from the court for having relations with anyone else while her marriage is subsisting. Allahabad High Court has said this important thing. Saying this, Allahabad High Court clearly refused to provide security to a couple. Justice Vivek Kumar Singh of Allahabad High Court heard the petition filed for security and said that illicit relations do not have the right to get protection from the police.
After hearing the petition, the bench of Allahabad High Court said that because of being married, husband and wife have the legal right to live together. This right cannot be taken away because of any third person. On the petition filed by the live-in couple, Allahabad High Court said that the people giving it are already married. Unless the divorce takes place, permission to live with a third person cannot be given. A married woman and her male friend live in a live-in relationship in Saharanpur, UP. He had filed a petition in the Allahabad High Court demanding no interference from anyone in his peaceful life and security.
In the petition, the live-in couple had argued that they are adults and hence are living together willingly. At the same time, on this petition, the government lawyer said in Allahabad High Court that legally the woman is still the wife of a man. On behalf of the government, the High Court was told that no court has given any order regarding the divorce of the woman. After this argument of the government lawyer, Allahabad High Court refused to provide security to the woman, terming her live-in as illegal. The court even said that bigamy and adultery are the same.
