The Motor Accident Claims Tribunal (MACT) in Thane has ordered a compensation of Rs 1.15 crore to the family of a couple who died in a road accident in 2019.
The tribunal ordered that Rs 75.29 lakh be given to the couple’s 16-year-old daughter and Rs 20 lakh each to the parents of the deceased.

MACT member RV Mohite, in the order passed on Tuesday, said the accident occurred due to careless driving of the truck.
Claimants’ lawyer SJ Tiwari told the tribunal that the accident took place on February 2, 2019, near Firoz Shah Mehta Bridge on the Eastern Express Highway in Vikhroli area of Mumbai. He told the tribunal that engineer Akshay Pramod Gupta (34), his wife Aarti Akshay Gupta (32) and daughter, residents of Thane city in Maharashtra, were traveling on a scooter at slow and moderate speed.
The lawyer said that a truck being driven at excessive speed, uncontrolled speed and in a careless manner hit the scooter from behind.
Due to the collision, the husband and wife fell from the scooter and the wheel of the truck passed over them. The couple died on the spot. The claimants told MACT that the man earned Rs 65,000 per month.
The truck driver fled from the spot without providing any medical aid to the couple. After this, Vikhroli police of Mumbai registered a case against him and filed a chargesheet.
The defendant truck owner did not appear before the tribunal and the case was adjudicated against him ex-parte. However, the truck’s insurer contested the claim on various grounds.
The tribunal relied on police documents, the investigating officer’s report, including CCTV footage and eyewitness statements to prove the truck driver’s negligence. The tribunal ordered compensation of Rs 1,15,29,584 on two separate claims.
The tribunal ordered that Rs 75,29,484 be given to the couple’s minor daughter and Rs 20 lakh each to the father and mother of the deceased.
