The Attorney General (AG) wrote to the Chief Justice of India B. R. It has given consent to initiate contempt action against the lawyer who tried to throw shoes at Gavai. The Supreme Court was informed about this on Thursday.
Solicitor General Tushar Mehta and Supreme Court Bar Association (SCBA) chief and senior advocate Vikas Singh told Justice Surya Kant and Justice J. Bagchi requested the bench to hear the contempt case against lawyer Rakesh Kishore, who threw a shoe at the Chief Justice.
Singh said that countless materials have been circulated on social media regarding this incident that took place on October 6, which is hurting institutional integrity and dignity.
Mehta and Singh requested the court to pass an order prohibiting posting of such material on social media, saying that all kinds of derogatory comments were being made.
The bench said that the fundamental right to speech and expression cannot be at the cost of the dignity of others.
It pointed to the ill effects of the “unregulated” nature of social media and said, “We are both products and consumers of content”.
This unprecedented incident of an attempt to throw a shoe at the Chief Justice happened on October 6. That day, around 11:35 am, in court room number one, 71-year-old advocate Rakesh Kishore took off his shoes and tried to throw them towards the bench headed by the Chief Justice. The security personnel immediately took the accused advocate into custody.
Unperturbed by the incident that took place during the court proceedings, the Chief Justice asked the court officials and security personnel present in the courtroom to ignore it and to release the accused lawyer, Rakesh Kishore, after giving a warning.
