The woman started feeling weak after the husband forced her to have a relationship, demanding dowry harassment against her husband and family members.
A woman living in Mumbai had filed a complaint against her own husband for forcibly having sex with her. However, the court rejected this case saying that the husband has not done anything wrong and it is not a matter of investigation in any way. The matter was heard by Mumbai’s Additional Sessions Judge Sanjshree J Gharat.
According to the information of the case, the woman was married on November 22 last year. The woman said in her complaint that after marriage her husband and in-laws started atrocities on her. All of them used to physically torture her and abuse her and even taunt her. Not only this, he had also demanded dowry from him. The woman accused her husband that on January 2, when both of them had gone to the Mahabaleshwar hill station, her husband had forcibly had sex with her. The woman said that after this she was feeling unwell, due to which she went to the doctor. Where the doctor told that he was paralyzed in the lower part of his waist.
After the doctor’s report, the woman lodged an FIR against her husband and others in Mumbai. During the hearing of the case in the court, the husband said that he and his family were being implicated in a false case. He has never demanded dowry. During the hearing of the whole case, the judge said that the woman’s case cannot be considered just as she had complained against the demand for dowry, but she did not specify how much the demand for dowry was.
The judge observed that there was no legal basis for forcible intercourse by the husband. It is really painful to have a disease like paralysis at such a young age, but the husband and his family cannot be held responsible for this. Apart from this, the husband has shown readiness to cooperate during the investigation, due to which there is no need for remand.
