Prayagraj, October 15 (IANS). Allahabad High Court on Wednesday stayed the administrative action in the matter of giving notice to the mosque built on the pond land in Sambhal, Uttar Pradesh. Now no action will be taken on the structure built on the pond land in Sambhal.
Allahabad High Court has given a big order in the case of illegal construction on eight bigha land located in Mohalla Hatim Sarai of Raisatti police station area of Sambhal. People are happy after the order. The Tehsildar’s notice was challenged in the Allahabad High Court, after which the Allahabad High Court has given the order on the petition of Mahmood Alam and 18 others.
The Sambhal administration had given notice of illegal construction on the pond land and had put red marks on everyone’s houses. A notice was issued declaring the petitioners’ house illegal as it was built on pond land.
Earlier, the administration had given notice by putting red marks on all the houses and sought reply within 15 days. Besides, instructions were also given to remove illegal construction. During this period, the administration had marked about 40 houses as illegal.
The administration had talked about taking action to demolish the illegal constructions with bulldozers if satisfactory response was not received from all the concerned parties within 15 days. After this people knocked on the doors of the court.
Senior advocate Rakesh Pandey, advocate Irshad Ahmed and Ayub Khan appeared on behalf of the petitioners in the court. The petitioner claims that the administration has initiated action without checking the tehsil records. After hearing all the parties, the court has issued an order not to take any action. Also, the court has asked the petitioners to apply to the Tehsildar within four weeks.
