Delhi court will hear the voter list case against Sonia Gandhi today

New Delhi, April 18 (IANS). A Delhi court is scheduled to hear on Saturday the criminal revision petition filed against Sonia Gandhi for allegedly fraudulently enrolling her name in the voter list before acquiring Indian citizenship.

The petitioner has completed his arguments, whereas the arguments presented by Sonia Gandhi are still not conclusive.

Earlier, on March 30, the Rouse Avenue court had adjourned the case after a partial hearing and scheduled it for April 18 to allow the defense to continue its arguments.

The revision petition, filed by advocate Vikas Tripathi, has sought registration of an FIR and investigation into the alleged irregular inclusion of Sonia Gandhi’s name in the voter list without Indian citizenship.

During the hearing, the petitioner’s counsel concluded his arguments by arguing that the case pertains to a declaration made by a foreign national and this could not have happened without the use of forged documents or unfair means.

He has stated that certified copies of the voter lists have been obtained and placed on record to demonstrate that prima facie, a false declaration was made, which mandates an investigation into the alleged forgery and fabrication of documents.

However, the arguments presented by Sonia Gandhi were not conclusive and will be considered on the next date of hearing.

In an order passed on December 9, 2025, Rouse Avenue Court Special Judge (Prevention of Corruption Act) Vishal Gogane agreed to examine the revision petition and issued notice to Sonia Gandhi as well as Delhi Police, directing them to list the matter for further hearing.

Earlier, the Magistrate Court had rejected the complaint seeking registration of FIR, saying that the judiciary cannot initiate an investigation which leads to undue encroachment into areas clearly assigned to constitutional authorities.

The court held that such interference was barred under Article 329 of the Constitution, which limits judicial interference in election matters other than election petitions. Opposing the review petition, Sonia Gandhi has told the court that the allegations are “politically motivated”, baseless and based on false and misleading facts.

In her reply, Sonia Gandhi said that questions related to citizenship fall entirely under the jurisdiction of the central government, while disputes related to voter lists fall under the jurisdiction of the Election Commission of India.

He has also said that no credible documentary evidence has been produced to prove the allegations of forgery or fraud and has described the proceedings as an abuse of the legal process.
