Amidst the new plan of President Donald Trump to implement a fee of US $ one lakh on working visas, lawyers and various companies are advising to return the H-1B visa holders who have gone out of the US and advise them to return immediately.
Trump on Friday signed a government order under an important development, which would affect Indian professionals working on H-1B visas in the US.
Under this order, immigrants working in ‘Special Business’ will not be allowed to enter the US for not paying US $ 100,000 with H-1B applications. This order will be effective from 21 September 2025 at 12:01 pm.
The lawyers and companies of immigration cases are warning the H-1B visa holders or their family members who are currently out of the US for work or holiday. He has advised such people to return to the US before the order came into force on 21 September. Experts have said that they return to the country within the next 24 hours, otherwise they can be prevented from returning.
Eminent immigration lawyer Seser Mehta, who lives in New York, said in a post on ‘X’, “Those who are out of America for H-1B visa business or holidays, if they are unable to enter before midnight of September 21, they will be trapped. It may be stuck that the H-1B visa holder in India may have missed a timely time, because India will not be able to come on time.”
Mehta said, “The H-1B visa holders in India can reach California before midnight of September 21, 2025.”
Users on social media posted excerpts from an internal email of Microsoft, in which the company has asked H1B visa holders and their dependents to avoid traveling out of the US and return immediately before 21 September.
It is understood that Microsoft has asked its employees to stay in America so that they are not prevented from re -entry in future.
David Bear, director of ‘Cato Institute’s Immigration Studies’, said in a post on ‘X’ that Indian H-1B employees have given ‘immense contribution’ to the US, including hundreds of billions of taxes, crores of dollars and trillion dollars services.
He said, ‘Indians are one of the most calm, intelligent and interesting communities living here. And what do we give in return? Badnami and discrimination… ‘.
