Madras. Madras High Court has once again given clear instructions that female employees should be given paid maternity leave even after the birth of their third child. This case is related to B., an employee working in Madras High Court. Mangaiyarkarasi, who had sought maternity leave for the birth of her third child. When he did not get leave, he filed a petition in the court. This case will be heard by Justice R. The division bench of Suresh Kumar and Justice Shamim Ahmed did it. During the hearing, the court was told that there is no provision for granting leave for the third child in the rules related to maternity leave of the Tamil Nadu government.
Keeping these things in mind, the court ordered the Registrar of the High Court to grant one year’s maternity leave to the petitioner along with all eligible economic benefits. The court also said that necessary steps should be taken to ensure that petitions are not filed again in such cases in future.
However, the court said that the Supreme Court has already made it clear that a female employee should get maternity leave even after the birth of the third child. Madras High Court has also given similar instructions in similar cases earlier.
Under this, the judges directed the Registrar General to send a circular related to this order to the registrars and officers of all the district courts. Along with this, a copy of this order was also asked to be sent to the Chief Secretary of Tamil Nadu and the secretaries and heads of departments of all departments were also asked to implement the orders of the Supreme Court and the High Court.
