Lakhs of people in the country live on rent, and their biggest problem is the arbitrary behavior of landlords. In some cases, a security deposit of six months is asked for before renting out the house, while in others the rent is increased without any written agreement. In view of this problem, the government is emphasizing on implementing the Model Tenancy Act in the entire country. The new Rent Rules 2025 make it clear that security will be monitored, rent will not be increased arbitrarily, and no one will be evicted without any reason. This law provides great relief to common tenants and makes the entire rental system more transparent and secure. Let us understand each point in simple words.

Arbitrary security deposit will no longer be allowed
With the new rules, landlords will no longer be able to ask for arbitrary security deposits. Residential homes can be guaranteed a maximum of two months’ rent, while commercial spaces like shops and offices are limited to six months. This will significantly reduce the financial burden on tenants while renting a house.

The house cannot be given on rent without a written rent agreement. The Model Tenancy Act states that every tenancy must have a written rent agreement. The rent, increase, responsibility for repairs and rental period are clearly mentioned in it. Both the parties will have to submit this agreement to the rent authority within 60 days of making it.

Rent agreements will now be registered online also

States will have to create a digital platform where rent agreements will be recorded online. This record will be officially recognized and will be considered the most important evidence in case of any dispute. This will make the entire process easy, safe and clean.

Strict rules on increasing fare:
Landlords will not be able to increase the rent without any reason. Increase in fare will be limited to the amount already decided in the written agreement. Additionally, a written notice will be required to be given to the tenant three months prior to any rent increase.

Cannot be removed without reason.
Landlords will no longer be able to evict tenants at will. This requires an order from the rent authority, and the reasons must be legally proven, such as non-payment of rent, illegal activity, or subletting without permission.

Failure to vacate on time may result in heavy fines

If a tenant does not vacate even after the end of the lease, he will have to pay double the rent for the first two months and four times the rent thereafter. This will also provide security to landlords.

Uniform template will make rental agreement easier

The government is preparing to bring a uniform rental agreement template so that no party can add conditions as per its wish. This will provide relief to the tenants from unfair conditions.

Now disputes will be resolved quickly, which will eliminate the need to go to civil court.

The new law provides for a three-tier system to resolve disputes: Rent Authority, Rent Court, and Rent Tribunal. Its purpose is to ensure that rent-related issues are resolved within 60 days. This will ease lengthy legal processes.

It has not been implemented across the country yet, so states will have to change their rules. This law is a model. It is the responsibility of the states to implement it. Many states like Uttar Pradesh and Tamil Nadu have already made their new fare laws. Delhi is also preparing to bring a new law to replace the old 1958 law.

Rental market will become more safe and secure
The new rules will create a system that protects tenants and gives legal recourse to landlords. With this, the rental market will become transparent in the entire country and people will get relief from arbitrary taxes.
