Yamuna City: High Court's decision clears the way for 1500 people to get plots, petitions rejected

Allahabad High Court, while giving an important decision, has given great news to the allottees of Yamuna City under Yamuna Expressway Industrial Development Authority (YEIDA). The court has outrightly rejected 14 petitions of farmers challenging the land acquisition in 2009. After this decision, the path for allotment of stranded plots in Sector-18 and Sector-20 has become completely clear. This decision is no less than a big relief for more than 1500 allottees who have been waiting for their plots for a long time.

The court held the acquisition process valid, said – the decision was taken in public interest and the legal process was followed.

While hearing the case, the High Court made it clear that the process of land acquisition was completely within the legal ambit. The court held that the acquisition was made in the larger public interest and there was no gross violation of rules. The Court also commented that no legal deficiencies were found in the compensation and process. Also, this matter has already been adjudicated at various levels, which proves that the matter has already been dealt with at a high level. This comment of the court has further strengthened the side of the allottees.

The authority rejected the farmers’ arguments regarding compensation and possession with facts.

The petitioner farmers had argued in the court that their land was acquired without due process and they were not given adequate opportunity to present their views. Some farmers also alleged that the documents related to compensation and possession were incomplete. However, Yamuna Development Authority (YEIDA) presented its stand strongly before the court. The authority said that the acquisition has been done completely as per the rules, compensation has been given to the affected farmers and the possession of the land has also been taken as per the legal process. Agreeing with the arguments of the authority, the court rejected the petitions of the farmers.

Now development works will get wings in Sector-18 and 20, 1500 allottees will soon get ownership rights.

This order of the High Court will have a direct impact on the development work of Yamuna City. Now the stalled development works in Sector-18 and Sector-20 will accelerate. According to the authority, work on roads, electricity, water and other infrastructure facilities will be expedited with immediate effect. The biggest thing is that about 1500 such allottees, who were not able to take possession of their plots due to legal issues, will now be able to get their plots. Long pending residential and other schemes are now expected to gain new momentum.

The path of allotment became easier, now important auction of plots will be held on 24th February

With the legal hurdles removed, Yamuna Development Authority has also started work on future plans. According to the information given by the authority, the plots will be auctioned on 24th February. This auction will be held under the plan of Sector-17, 18 and 22D. The application process for this has already been completed. Only those applicants who had submitted their applications by January 7 will be able to participate in this auction process. After the court’s decision, now investors and buyers are also looking towards Yamuna City with more enthusiasm.
